If you do not agree, please do not use the Platform.<\/p><hr \/><h3>1. Definitions<\/h3><ul><li><p><strong>Platform<\/strong>: Refers to the UpMLM software and website.<\/p><\/li><li><p><strong>User<\/strong>: Anyone registered on the Platform.<\/p><\/li><li><p><strong>Content<\/strong>: Any data, information, text, files, courses, or materials uploaded or created by Users.<\/p><\/li><li><p><strong>Company<\/strong>: Refers to Spinlegacy Unipessoal LDA.<\/p><\/li><\/ul><hr \/><h3>2. Service Description<\/h3><p>UpMLM is a CRM platform designed for entrepreneurs in network marketing, social selling, or multilevel marketing (MLM). It offers tools such as:<\/p><ul><li><p>Lead management<\/p><\/li><li><p>E-learning and training platform<\/p><\/li><li><p>Automation features (email, WhatsApp, SMS)<\/p><\/li><li><p>Landing page creation<\/p><\/li><li><p>Online planner<\/p><\/li><li><p>Event\/calendar management<\/p><\/li><\/ul><p>Users may access a <strong>Free Plan (Freemium)<\/strong> or upgrade to a <strong>Paid Plan<\/strong> (monthly or annually via Stripe).<\/p><hr \/><h3>3. Free Plan Limitations<\/h3><p>The Platform offers a Freemium Plan that provides free access to the UpMLM system with limited functionalities. Users may upgrade to paid plans at any time to unlock additional features and expanded capabilities.<\/p><hr \/><h3>4. User Eligibility and Conduct<\/h3><ul><li><p>Users must be at least <strong>18 years old<\/strong>.<\/p><\/li><li><p>Account sharing is <strong>not allowed<\/strong>.<\/p><\/li><li><p>Users are responsible for the content they upload.<\/p><\/li><li><p>Inappropriate or illegal content may result in account suspension, although no active moderation is applied by default.<\/p><\/li><\/ul><hr \/><h3>5. Payments and Cancellations<\/h3><ul><li><p>Payments are processed via <strong>Stripe<\/strong>.<\/p><\/li><li><p>All subscriptions are <strong>automatically renewed<\/strong>.<\/p><\/li><li><p>Users may <strong>cancel anytime<\/strong>.<\/p><\/li><li><p>A <strong>30-day money-back guarantee<\/strong> is available, no questions asked.<\/p><\/li><\/ul><hr \/><h3>6. Privacy and Data<\/h3><ul><li><p>Privacy Policy available at: <a href=\"https:\/\/upmlm.com\/privacy\">https:\/\/upmlm.com\/privacy<\/a><\/p><\/li><li><p>Required data: name and email address for registration.<\/p><\/li><li><p>Data is <strong>not shared<\/strong> with third parties.<\/p><\/li><li><p>Sensitive information (messages, stats, contacts) is stored privately and is only accessible by the user who created it.<\/p><\/li><\/ul><hr \/><h3>7. Intellectual Property and Content<\/h3><ul><li><p>All user-generated content (e.g., courses, automations) remains the property of the user.<\/p><\/li><li><p>Public courses may be used as templates or examples by the Platform.<\/p><\/li><\/ul><hr \/><h3>8. Availability and Disclaimer<\/h3><ul><li><p>The Company aims to maintain <strong>95% monthly uptime<\/strong>.<\/p><\/li><li><p>We do <strong>not guarantee<\/strong> business success or network growth.<\/p><\/li><li><p>The Platform is provided <strong>&#8220;as is&#8221;<\/strong>. We are not responsible for any losses resulting from platform use, including data loss or business interruption.<\/p><\/li><\/ul><h3>9. Consent for Data Use in AI Training<\/h3><p>By using the Platform, the User grants Spinlegacy Unipessoal LDA full, non-exclusive, worldwide, and royalty-free consent to collect, process, and use all information and data entered, generated, or transmitted through the Platform \u2014 including, but not limited to, data about leads, members, notes, communications (via WhatsApp, SMS, email, or other integrated messaging systems), and the activity of other users linked to the User\u2019s organization \u2014 for the sole purpose of training and improving artificial intelligence systems that enhance the performance, personalization, and automation features of the UpMLM platform. Such processing is strictly limited to service improvement purposes and may also benefit other UpMLM users, without ever disclosing or making identifiable any personal or confidential data externally. All data processing shall comply with applicable data protection laws, including the GDPR, and will be handled with appropriate security and anonymization measures.<\/p><hr \/><h3>10. Support<\/h3><ul><li><p>Support is provided via <strong>email<\/strong> (<a href=\"mailto:client@upmlm.com\">client@upmlm.com<\/a>) from <strong>9h to 17h CET<\/strong>.<\/p><\/li><li><p><strong>Priority support<\/strong> is available for paying customers.<\/p><\/li><\/ul><hr \/><h3>11.
